Dear Members,

The Complying Development Expert Panel will be meeting on 6 February 2013 on the issue of increasing Codes SEPP use across the state.

The AIBS (NSW/ACT) position to be placed before the Panel is as follows:
The AIBS (NSW/ACT) is committed to the simplification and increased use of complying development in NSW.
The AIBS (NSW/ACT) position is that professional Building Surveyors, both private and council Accredited Certifiers, are best placed to achieve the objective of increasing complying development and to take on Code Assessable Development in NSW under any new Planning Act.
Professional Building Surveyors, being members of the AIBS can ensure that developments, especially those that would have prior to 1 July 1998 only required a Building Approval, are assessed and approved efficiently and effectively, inspected during construction and occupied to appropriate standards.
The AIBS NSW will be pushing for more simple and certain rules that are easily understood by the public as well as by councils so as to reduce errors, litigation and delays caused by the current overly complex State Environmental Planning Policy provisions under the NSW Housing and other codes.
There is a clear need to expand the role of Complying Development such that more may be approved efficiently and effectively by both private and council Accredited Certifiers (Building Surveyors), with significant savings and public benefits and without any adverse environmental outcomes.
The AIBS who represent both private and council Building Surveyors wish to see a return to a system as simple and certain as the former Building Approval and will work with the Department of Planning and Infrastructure to deliver this outcome utilising the Complying Development Certificate and if implemented by the new Planning Act by Codes Assessable Development.
The AIBS is looking forward to seeing the Minister for Planning Infrastructure release the white paper such that the new Planning Act can provide flexibility in environmental planning laws required to achieve these outcomes.
